The grievance of the petitioner, who is claiming himself as President of Gramin Vikash Sangharsh Samiti, is confined to direct the respondents not to construct boundary wall of Tools and Training Centre at Belwaiya More situated

southern side of Dinara – Bikramganj State Highway No. 15, from where a connecting passage way and water channel are passing through, which are being used for the agricultural purposes for more than hundred years.

Despite the fact, the said passage way and water channel lie on the Anabad Bihar Sarkar Parti Land, the Government of Bihar, Department of Industries, illegally allotted the land to District Industries Centre. Now, the concerned official respondents propose to construct a boundary wall of Tools and Training Centre, that would cause absolute blockage and hindrances in passage way and water flowing channel which are being used for the agricultural purposes of the nearby farmers.

It was also argued that the petitioner raised his grievance before all the authorities and submitted detailed representation, but to no avail. Thus, the present Public Interest Litigation.

Considering the grievance of the petitioner, which is only confined to the use of passage way and water channel connecting to raiyati land of farmers, this Court is of the opinion that the present Public Interest Litigation is ill advised and wholly misconceived.
