Heard learned counsel for the parties.

This writ petition has been filed for quashing of advertisement dated 21.09.2020 issued by the respondent no. 7 for appointment of Assistant Professors on requisition made by the Human Resources Development Department, Bihar regarding appointment of Assistant Professor on regular basis in the constituent colleges under the different Universities of Bihar in the different subject and further for directing and commanding the respondents to consider the case of the petitioners and other similarly situated Guest faculties/part-time teacher in the different subjects appointed through the advertisement no. GFPT/01/2019 issued by the respondent no. 4, the B.N. Mandal University for their absorption/continuation on the said post till they attain the superannuation with all legal and consequential benefits, keeping in view of the facts that the petitioners in different subject under the respondent University

have been appointed through the process of selection including the advertisement, educational qualification and other eligible criteria for such appointment in terms of respondent no. 6, the University Grant Commission guideline and further for any other appropriate relief/reliefs for which petitioners are entitled in the facts and circumstances of the case.

Learned counsel for the petitioners submits that an advertisement bearing no. GFPT/01/2019 was published for appointment of guest faculty/part-time teacher under the signature of Registrar of University dated 12.01.2019 in different subjects. Since the petitioners have all the requisite qualification for appointment to the post of Assistant Professor in terms of University guideline, they applied for such appointment within time. Petitioners, being the eligible candidates, were called for interview on different dates before the Selection Committee and finally they were selected on the post in question. The petitioners have joined their respective post according to their subject and since then they are working on the post to the best of their ability.

Learned counsel for the petitioners further submits that within a year of such selection and appointment of guest faculty/part-time teachers under the respondent-University, the

respondent no. 7 issued an advertisement on 21.09.2020 for appointment of regular Assistant Professor in the different Universities and its colleges in different subjects only to dispense with the service of the petitioners.

A counter affidavit has been filed on behalf of the respondents in which in para-7, it is, inter alia , stated that an identical issue was raised before this Court in C.W.J.C. No. 10264 of 2021 along with other analogous cases with regard to K.S.D.S. University, Darbhanga and other university and this Court, after hearing of the matter, was pleased to dismiss the writ petition observing that if there are posts lying vacant even after regular selections are made, the petitioners shall not be replaced by another set of Part-Time Assistant Professors and will be allowed to continue and the present order shall not come as a prejudice to them.

In view of the facts and circumstances as mentioned above and in the light of the order passed in C.W.J.C. No. 10264 of 2021 along with other analogous cases, this writ petition stands disposed of.
