The brief facts of the case are that petitioners’ services as Panchayat Teacher have been terminated by letter no. 3067 dated 10.10.2009, issued by District Superintendent of Education, Nawada, on the ground that the petitioners have not passed intermediate examination within 33 months from their

initial selection on the post of Shiksha Mitra, though, later on, they have passed the intermediate examination in the year 2006. For redressal of their grievances, petitioners had to approach the District Teachers Employment Appellate Authority but without approaching the said authority, they have directly approached this Court.

In above view of the matter, the petitioners are granted liberty to approach the District Teachers Employment Appellate Authority, Nawada, by filing an appeal, against the aforesaid order dated 10.10.2009.

It is made clear that if an appeal is filed by the petitioners within a period of four weeks from today, along with a petition for condonation of delay, the District Teachers Employment Appellate Authority, Nawada shall consider the same and pass a reasoned order, in accordance with law, after giving an opportunity of hearing to the person(s) concerned.

With the aforesaid observations and directions, the writ application is disposed.
