Heard learned counsel for the petitioner and learned counsel for the State are present.

The present writ petition has been filed for direction to the respondent to appoint the petitioner as Anganwari Sevika whose name has been figured as sole candidate in the merit list prepared for selection of Anganwari Sevika.

Learned counsel for the petitioner submits that for her grievances, the petitioner has filed representation before the District Magistrate, Banka but till date her representation has not been disposed off.

Counsel for the State submits that the grievance of the petitioner is frivolous and she is not entitled for selection as mentioned in Paragraph 7 of the counter affidavit.

Upon perusal of the records, it transpires to this Court that all the persons who have participated in the appointment process has not been made party in the present writ petition.

As such, the present writ petition is disposed off directing the petitioner to file a fresh representation before the District Magistrate, Banka and District Magistrate, Banka within 30 days from this order, thereafter, he upon hearing all the concerned parties shall pass reasoned and speaking order on the representation filed by the petitioner within 90 days, counting from the date of their appearance.
