The petitioner has filed the instant application for

the following relief/s:-

“(a) That, this application is being filed for issuance of a writ in the nature of mandamus or any other appropriate writ or writs directing the respondents for giving promotion to the petitioner in graduate trained pay scale treating the petitioner’s qualification equivalent to graduate trained/ Post graduate as per the notification of the Bihar Government vide letter no. 1097 dated 9.7.2009 and for payment of the same

without making any further delay treating the petitioner's case similar to the case of others, who having similar qualification are getting the benefit by treating the degree of Up-shastri as intermediate, Shastri as graduate and Acharya as graduate trained/Post Graduate.

Primary Education, Bihar, Patna (respondent no. 2) wherein in paragraph no. 9 the following statement has been made:-

“That it is most humbly submitted that accordingly, in the light of the above mentioned , the Petitioner, a retired teacher of U.M.V. Methawalia, Chhapra Sadar has been promoted to Level-07 (Graduate Trained Scale) w.e.f. 16.04.2011 and Headmaster’s pay scale (Level-08) has been granted w.e.f. 31.12.2017 with retrospective effect vide office order contained in Memo no. 603 dated 25.02.2024 issued by the District Education Officer, Saran.

In view of the above, in the opinion of the

Court, nothing remains to be decided so far as the instant writ application is concerned. It goes without saying that the consequential financial benefits arising out of the order dated 25.2.2024 giving the graduate trained scale to the petitioner with effect from 16.4.2011 shall be paid by the District Education Officer, Saran at Chapra (respondent no. 6) to the petitioner within a period of four months from the date of receipt/ production of a copy of this order.
