The grievance of the petitioner is only confined to the expeditious disposal of Jamabandi Cancellation Case No. 68 of 2020-21, which is pending since 23.09.2021 before the Additional Collector, Bhagalpur.

Learned Advocate for the petitioner contended that the land, in question, was purchased by the father of the petitioner through registered sale deed. Having purchased the land,

the father of the petitioner applied for mutation and the same was done. Thereafter, jamabandi has also been created and running in the name of the petitioner. After the death of the father, the petitioner has been coming in continuous peaceful possession over the land, in question. However, in the year 2005-06, the petitioner came to know that with respect to some portion of the land, the private respondents have got mutation in their favour and created jamabandi . The matter with respect to cancellation of jamabandi is pending since long. The notices have also issued and the paper publication has also been made; irrespective of this fact, the private respondents did not ensure their presence and matter is kept pending. Thus, in such circumstances, the petitioner approached before this Court for early disposal.

Learned Advocate for the State contended that the matter appears to have been pending for the last three years and the Additional Collector, in seisin of the matter, shall dispose of the same within reasonable period.

Regard being had to the submissions made on behalf of the parties and considering the limited grievance of the petitioner, the writ petition stands disposed off with a direction to the Additional Collector, Bhagalpur to take up the Jamabandi

Cancellation Case No. 68 of 2020-21 and bring it to its logical conclusion within a period of four months, from the date of receipt/production of a copy of this order, after giving proper opportunity of hearing to all the stake holders.
