3 16-04-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Amdabad P.S. Case No. 210 of 2023, lodged on 09.08.2023 under Sections 341, 323, 447, 376, 504 of the Indian Penal Code.

As per the prosecution case, FIR has been lodged against the sole petitioner. The allegation against the present petitioner is that he has committed rape and also assaulted the informant using abusive language.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

further submits that the criminal antecedent of the petitioner is clean and he is in custody since 10.08.2023. Counsel also submits that the final form/report has been submitted by the police which is annexed as Annexure-2.

Learned APP for the State opposes the prayer for bail of the petitioner.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail on furnishing bail bonds of Rs.30,000/(Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No. 210 of 2023, subject to the conditions as laid down U/s 437(3) Cr.P.C.
