In the present case, the petitioner seeks bail in connection with Rahui P.S. Case No. 366 of 2024, registered for the offences under Sections 309(4) of the Bharatiya Nyaya Sanhita.

As per the prosecution case, three youths snatched the motorcycle of the informant and told him to make payment of Rs. 10,000/- for return of the motorcycle. They also took away Rs. 5,000/- in cash from the informant. The name of the petitioner transpired during investigation as one of the accused persons involved in the said occurrence.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been

falsely implicated in this case. The petitioner works as a Seizure Manager with Raj Kumar Enterprises Repo Agency. The agency was contacted by a finance company for recovery of the motorcycle financed by the company since the informant failed to make payment of the monthly installments as he had taken loan of Rs. 78,289/- on 28.12.2022 from the finance company. As the informant was not ready to make payment of dues amount despite legal notice, his motorcycle was seized as agreement already stood terminated. The police under the influence of the informant who is a journalist falsely implicated the petitioner and other co-accused person. The petitioner is under custody since 18.07.2024 and charge sheet has been submitted. The petitioner is having clean antecedent.

Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that recovery of motorcycle has been made from the house of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the period of custody of the petitioner, background of the dispute, period of custody of the petitioner and submission of charge sheet and the clean antecedent of the petitioner, the petitioner is

directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.II, Nalanda, Biharsharif/concerned court, in connection with Rahui P.S. Case No. 366 of 2024, subject to the condition laid down under Section 437(3) of the code of Criminal Procedure and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the below, if so required by the learned trial court.

¶25

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
