The petitioner apprehends his arrest in connection with Patrakar Nagar P.S. Case No. 197 of 2023, registered for the offences punishable under Sections 452, 341, 323, 324, 307, 354 and 34 of the Indian Penal Code.

It is alleged that on the fateful night of the occurrence, when the petitioner and others were digging nala in the land of the informant, a protest was made whereupon all the F.I.R. named accused persons including the petitioner armed with lathi, iron rod and hockey sticks assaulted the informant and others. It is specifically alleged that this petitioner assaulted the informant over his head by means of rod, due to which he

sustained serious injury. Other accused persons also snatched the valuables.

Learned counsel appearing on behalf of the petitioner submits that in fact the informant and her persons were the aggressors and on account of digging of nala some altercations took place resulting into scuffle between the parties wherein the persons of both the sides have sustained injuries. He further submits that so far the injury sustained to the informant is concerned, the same has been found to be simple in nature, which fact is also evident from the impugned order. He next submitted that the parties are next door neighbors and on a trifle this occurrence has taken place. That apart, the petitioner is a man of fair antecedent and he undertakes that he will fully cooperate in the investigation or in the proceeding of the Court.

On the other hand, learned counsel for the State opposed the pre-arrest bail application and submits that specific allegation of assault has been leveled against the petitioner.

Regard being had to the submissions made on behalf of the parties and considering the nature of injuries coupled with the fair antecedent of the petitioner and his undertaking, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below

within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1^st Class, Patna in connection with Patrakar Nagar P.S. Case No. 197 of 2023, subject to the conditions laid down in Section 438(2) Cr.P.C. with the further condition that one of the bailors shall be the own/close family members of the petitioner.
