Heard learned counsel for the parties.

Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 304B/34 and other ancillary sections of the Indian Penal Code.

It is a case of dowry death and petitioner is motherin-law of the deceased.

Learned counsel appearing for the petitioner submits that the petitioner is separate in mess and business. There is general and omnibus allegation against the petitioner. Co-accused, with similar allegation, have already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No.41993/2023.

Considering the fact that no overt act has been alleged against the petitioner who is a lady, prayer for bail of the

petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in Madhepurea Ghailadh OP Police Station Case No. 317 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
