Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Hajipur (T) PS case no. 427 of 2019 dated 15.05.2019, disclosing offences punishable under Sections 356, 379 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that on 15.05.2019, the informant was returning from Allahabad Bank after withdrawing Rs. 1 lac and Rs. 50,000/was already there in her bag. When she moved about 100 yards from Anjanpir Chowk, two persons on a motorcycle came and snatched her bag, which also contained mobile phone,

pass-book, Aadhar card, Pan card and Voter I.D. card.

Learned Counsel for the petitioner submits that the

petitioner has falsely been implicated in this case due to suspicion. He further submits that the First Information Report has been lodged against unknown and the petitioner has been implicated in this case on the basis of him being accused in Hajipur (T) PS case no. 426 of 2019, which was also instituted on 15.05.2019 having similar allegation. He further submits that nothing has been recovered from the conscious possession of the petitioner.

Learned counsel for the State as well as Informant vehemently opposed the prayer for bail and submits that paragraph 33 of the case diary depicts that petitioner was arrested in Hajipur (T) PS case no. 426 of 2019 and in his confessional statement, he has confessed his involvement in this case.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that the petitioner has criminal antecedent of similar nature of offence and he has confessed his involvement in this case during his confessional statement in Hajipur (T) PS case no. 426 of 2019 and motorcycle used in the offence has been recovered

from the possession of the petitioner, I am not inclined to grant the petitioner privilege of anticipatory bail.
