This is an application seeking restoration of Cr.

APP(DB) No. 602 of 2023 which stood dismissed for noncompliance with the peremptory order dated 16.02.2024 passed by this Court.

2. Learned counsel for the petitioner submits that the learned Advocate of the appellant in Cr. APP(DB) No. 602 of 2023 who was earlier making pairavi in the said case did not take steps to inform the appellant’s pairvikaar and as a result whereof the appeal stood dismissed which the appellant came to know after a considerable period. He belongs to the

economically weak family and due to the same, it took some time in engaging an Advocate.

3. There is no opposition to this application.

4. In the circumstances, we restore Cr. APP(DB) No. 602 of 2023, subject to the condition that learned counsel for the appellant shall remove the defects in the said appeal within three weeks from today.

5. If the defects stand removed in Cr. APP(DB) No. 602 of 2023, attach the said case with Cr. APP (DB) No. 1043 of 2023.

6. This criminal miscellaneous application stands disposed of.
