The petitioners apprehend their arrest in connection

with Complaint Case No. 1066 of 2018 registered under Sections 448, 452, 323, 379, 380, 394, 354 and 504/34 of the Indian Penal Code.

As per complaint case, on the alleged date and time of occurrence, all the accused persons including these petitioners came at the door of informant and started abusing him and assaulted informant and his family members. It is further alleged that the accused persons also tried to outrage the modesty of female family members of the complainant.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to prior enmity. It is further submitted that petitioner no. 6 has earlier lodged an FIR bearing Bariyarpur P.S. Case No. 320 of 2016 against the son of informant and others for murder of his son, and in retaliation, this false and concocted case has been lodged. Though there is allegation of assault against the petitioners, but there is no injury report on record to substantiate the same. Rest of the allegations are ornamental in nature. Petitioners claim clean antecedent.

Learned A.P.P. appearing on behalf of the State opposed the bail application and submits that petitioners are named in the First Information Report. There is specific allegation of assault against these petitioners.

Having considered the aforesaid facts and circumstances of the case, let the above named petitioners be

released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Saran at Chapra in connection with Complaint Case No. 1066 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
