1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 323, 353, 224 and 225 of the IPC and Section 45 of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and it is not a case of recovery of liquor rather what the informant alleges is that 87.280 litres of liquor was seized by the police and as such the police was going to the place of the learned Magistrate for getting the liquor remanded but since it was late as such the police was asked to come the next day but in between the

apprehended accused started to flee and the police persons also went behind them, in the meantime it is alleged that the accused persons including the petitioner fled with the seized liquor. The learned counsel counsel submits that the petitioner has been falsely implicated in the present case and the allegation is general and omnibus in nature.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bairiya P.S. Case No. 284 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
