Heard learned counsel for the petitioner as well as

learned APP for the State.

In this case, the petitioner is seeking regular bail in connection with Dhanarua P.S. Case No. 378 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022 and Sections 338 and 336 of the Bharatiya Nyaya Sanhita 2023.

As per allegation, 224.250 liters of foreign liquor was recovered from the vehicle of the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. Nothing has been recovered from his conscious possession and he is under custody since 13.07.2024.

Considering the above-mentioned facts and circumstances as well as the clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Excise II, Patna in connection with Dhanarua P.S. Case No. 378 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
