Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 452, 380, 427, 307, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has antecedent of two cases and the informant alleges that 23 named and 20-25 unknown accused created ruckus, when police had gone to remove encroachment on land of Praveen Kumar Singh, further the accused persons pelted stones and created obstruction in removing the encroachment which was initiated on the orders of the High Court, further though

encroachment was removed, but when father of the informant, who is Manager of Praveen, tried to resist the accused persons, then accused persons tried to strangulate him, further Ram Sakal and Arjun Sada assaulted Arvind by an iron rod, who tried to save his father and the blow was repeated, further on orders of Ram Sakal, accused Suresh poured petrol on Arvind and Anil tried to immolate him by striking a matchstick, but the informant snatched the matchstick, further Saudagar and Manohar assaulted his mother and aunt by fist and leg, and Ratilal looted Rs. 54,000/-.

The learned counsel for the petitioner submits that from from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation is alleged against the petitioner. It is also submitted that specific allegation of assaulting Arvind is against Ram Sakal and Arjun, and the petitioner has been implicated in the instant case with general and omnibus allegation. It is also submitted that the petitioner will not abscond, rather will cooperate in the investigation.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kusheshwar Asthan P.S. Case No. 292 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
