Heard learned counsel for the petitioners and learned

2. The petitioners have preferred this application for grant of regular bail in connection with Sikta P.S. Case No. 49/2024 dated 13.04.2024 registered for the offence punishable u/s 341, 323, 324, 326, 307 and 504 read with 34 of the Indian Penal Code.

As per the prosecution case, the informant being security guard at the Primary Health Centre, Sikta has alleged that one Aurengzeb Alam had come for treatment and after the treatment Dr. Brajkishore Prasad started preparing injury report. In the meantime, the petitioners and the co-accused person came

and started pressuring Dr. Brajkishore Prasad to make false injury report and they started abusing and making scrimmage. When the informant intervened, the petitioners and the coaccused person slammed the informant on the ground. Thereafter, the petitioner no. 2 Shamim Alam and the coaccused Vodhair Alamm caught hold of his hands and slammed the informant on the ground and the co-accused Imteyaj Alam with an intention to kill inflicted knife blow on the head and back of the informant causing injury.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The specific allegation of inflicting knife blow is against the co-accused Imteyaj Alam. There is general and omnibus allegation against the petitioners. Learned counsel has submitted that the informant sustained four injuries out of which injury no. 2 is grievous in nature whereas other injuries are simple in nature. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 13.04.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances

of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Bettiah, West Champaran, in connection with Sikta P.S. Case No. 49/2024.
