Though the notice was validly served upon opposite party no.2, nobody appeared on behalf of opposite party no. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A, 494 of the Indian Penal Code.

As per the prosecution case, opposite party no. 2 alleged that the petitioner has performed second marriage with another girl.

the petitioner is innocent and has falsely been implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that the petitioner is unmarried and he has no relation with O.P. No. 2, only under misguiding circumstances to extort money the present case was instituted against the petitioner. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Considering the facts and circumstances of the case, the provisional bail granted by order dated 08.08.2024 is hereby confirmed.
