2 02-02-2024 Heard learned counsel for the petitioners and

learned APP for the State.

The petitioners seek bail in Warisliganj P.S. Case No. 498 of 2023, instituted for the offences punishable under Sections 420, 467, 468, 471, 34, 120(B) of the Indian Penal Code, Sections 66(B) and 66(D) of the I.T. Act.

The prosecution case, in short, is that, the accused persons used to cheat the innocent people by forming fake website in the name of sanctioning loan by fake mobile numbers. The police party apprehended them and on search several mobile phones were recovered.

Learned counsel for the petitioners submits that the

petitioners are innocent and has committed no offence. The petitioners were arrested on the basis of suspicion and have been falsely implicated in this case. The petitioners have no any criminal antecedent as has been stated in paragraph no. 3 of the present bail application. Learned counsel for the petitioners further submits that similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 30.01.2024 passed in Cr. Misc. No. 2361 of 2024. The petitioners are languishing in judicial custody since 09.10.2023.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, taking into account the period of custody undergone by the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Warisliganj P.S. Case No. 498 of 2023.
