The petitioner is in custody in connection with Cyber P.S. Case No. 21 of 2023 for the offence punishable under sections 292(A), 327, 354(A)(D), 376, 468, 469, 471 and 506 of the Indian Penal Code and Section 66, 66(c), 66(E), 67, 67(A) and 67(B) of the I.T. Act lodged on 30.08.2023 by the informant, Archana Kumari.

As per the prosecution story, the informant alleged that she got a friend request on Facebook and later, was sexually exploited in Mahakali Hotel at Begusarai. The photographs were also taken which allegedly was made viral. This led to the FIR.

In this case, the Coordinate Bench ( HMJ Nawneet Kumar Pandey ) considering the statement made by both the learned counsel for the petitioner as also the informant that they

have compromised the matter and decided to lead conjugal life, granted provisional bail to the petitioner for three months on 05.07.2024.

Since the time of provisional bail lapsed, the petitioner surrendered on 03.12.2024 and he is in custody since then.

Today, during argument, the learned counsel for the informant submitted that the lady now does not want to live with the petitioner.

The law will take it own course, the petitioner has remained in custody between 28.02.2024 to 05.07.2024 and now from 03.12.2024 till date. The charge-sheet stands submitted, an undertaking has been given that he shall diligently appear in trial, is nineteen years of age, in that background, this Court is inclined to grant him privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Cyber P.S. Case No. 21 of 2023 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official

document to show his/her bona fide;

¶22

(ii) the petitioner shall appear on each and every date

¶23

before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

¶25

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.
