Heard learned counsel for the petitioner and learned

APP for the State.

The petitioner seeks regular bail in connection with Baunsi P.S. Case No. 103 of 2023 for the offence registered under Sections 302, 120 (B) of the I.P.C. and Section 27 of the Arms Act.

As per the prosecution case, brother of the informant was murdered by some unknown persons when he had gone to talk with the owner of the JCB.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case only on the basis of suspicion. FIR has been lodged against unknown, however, during the course of investigation the name of the co-accused Naresh

Mandal, the husband of the petitioner transpired in the present case. He has further submitted that except the confessional statement there is nothing material against the petitioner. Petitioner is a woman having no criminal antecedent. She is in custody since 04.04.2024. Charge has already been frame by the learned trial court. The petitioner undertakes to co-operate in the trial of the present case.

Learned counsel appearing on behalf of the State opposes the prayer for grant of regular bail to the petitioner.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Baunsi P.S. Case No. 103 of 2023, subject to the following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on failure on two consecutive dated

without sufficient reason, the trial Court may cancel the bail
