Heard learned counsel for the petitioners and the

State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 325, 427, 379, 504, 506/34 of the Indian Penal Code.

Allegation against these petitioners is that they

assaulted informant and his cousin brother by lathi , bricks and iron rod causing injury on his head and other parts of body.

Learned counsel for the petitioners submits that present case is counter blast of Patahi P. S. Case No. 330 of 2023 which was lodged by petitioner No. 1 against informant

and others. F.I.R. has been registered after inordinate delay of 7 days which itself creates doubts about veracity of the prosecution case. Injuries allegedly caused by these petitioners are simple in nature. Petitioners have got clean antecedent.

Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case and simple nature of injuries, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Patahi P. S. Case No. 355 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
