Heard learned counsel for the petitioners and

learned APP for the State.

The petitioners apprehend their arrest in connection with Barun P.S. Case No. 572 of 2023 registered for the offence under Sections 147, 148, 149, 341, 323, 325, 307, 337 and 338 of the IPC and Section 27 of the Arms Act.

As per the prosecution case, the allegation against the petitioners is that they have assaulted the informant by means of garasa and lathi on his head.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is also submitted that one of the co-accused has already granted anticipatory bail in Cr. Misc. No. 20279 of 2024.

However, learned APP for the State vehemently opposed the prayer for regular bail.

On perusal of the FIR, injury report and impugned order dated 12.02.2024, it appears that the injuries found on the person of the informant are simple in nature caused by hard and blunt substance. Petitioners have got no criminal antecedent as stated in para 3 of the bail petition.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail in the event of their arrest or surrender before the court below within period of six weeks from today on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Barun P.S. Case No. 572 of 2023 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
