Heard learned counsel for the petitioner no. 4 and

learned A.P.P for the State.

This bail application is with regard to petitioner

no. 4 namely, Arjun Bhuiyan. So far other petitioners are concerned, they have already been granted bail vide order dated 12.03.2024.

The petitioner no. 4 seeks bail in connection with

P.S. Case No. 520 of 2023 dated 29.11.2023 registered for

the offence punishable under Sections 147, 148, 149, 323,

324, 307, 302, 379, 325, 504 of the Indian Penal Code.

The allegation against the petitioner no. 4 is that, he assaulted with tangi on the head of the informant's mother.

Learned Counsel for the petitioner no. 4 submits that the petitioner no. 4 is innocent and has been falsely implicated in this case. The allegation against the petitioner no. 4 is that he assaulted with tangi on the head of the informant's mother, which is not corroborated with the injury report. The petitioner no.4 is in custody since 04.01.2024, having four criminal antecedents and chargesheet has been submitted in the case.

Earlier vide order dated 12.03.2024 case diary and injury report was called for with regard to Ramni Devi. Final injury report of Ramni Devi has been received which shows that there is no obvious findings, no obvious hemorrhage or fractures. The doctor has opined that nature of injury is simple.

Learned A.P.P for the State opposes the prayer for bail of the petitioner no.4.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner no.4, namely, Arjun Bhuiyan be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate – III, Aurangabad in connection with Madanpur P.S. Case No. 520 of 2023.
