Heard learned counsel for the petitioner and the State.

The petitioner seeks regular bail in a case registered for the offence punishable under sections 147, 148, 149, 342, 302, 504, 506 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, FIR named accused persons reached in front of the house of the informant. Accused persons abused his family members and they made indiscriminate firing as a result of which brother of tihe informant sustained bullet injuries and died on the way to the hospital.

Learned counsel appearing for the petitioner submits that from perusal of the FIR itself it is evident that the petitioner is not named in the FIR and there is no allegation of any overt act against the petitioner in the FIR. During investigation, witnesses have not made any allegation against the petitioner. He is no way connected with the FIR named accused persons. Petitioner has been roped in this case only on the basis of Call detail record. However, the mobile number in question is in the name of petitioner’s mother. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 11.11.2023.

Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Udwant Nagar Police Station Case No. 461 of 2023.
