The petitioners are apprehending arrest in

connection with Banka P.S. Case No. 760 of 2023 instituted under Section 341, 323, 324, 325, 307, 354(B)/34 of the Indian Penal Code lodged on 16.11.2023 by the informant, Sunita Devi.

As per the prosecution story, due to previous dispute, the petitioners armed variously, came and assaulted the informant's side. The allegation against the petitioner nos. 1 and 2 is of assaulting by 'lathi' whereas the petitioner no.3 gave 'khanti' blow on the head of the informant. Accordingly, the FIR.

Though, learned counsel for the petitioners tried to impress upon this Court that there is omnibus allegation against the petitioners, learned APP pointed out that petitioner no.3, Rupesh Pandit gave 'khanti' blow on the head of the informant. Further, the other two petitioners also assaulted the informant's side and it has been pointed out by the learned APP that both the petitioner nos. 1 and 2 are having criminal antecedent.

In that background, all the petitioners are well advised to seek bail. Their anticipatory bail application stand rejected.
