Heard learned counsel for the petitioner and the State.

Petitioner apprehends arrest in a case registered for

the offences punishable under Sections 364/34 of the Indian Penal Code.

This petitioner along with other F.I.R. named accused persons is alleged to have abducted son of the informant from the premises of Shiv Mandir during an orchestra program.

Learned counsel for the petitioner submits that petitioner has falsely been implicated because he opposed the informant in panchayat election. There is no specific accusation of any overt act against the petitioner. He next submits that after investigation, police submitted final form against the petitioner.

case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1^st Class, Saharsa in connection with Mahishi P. S. Case No. 24 of 2013, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
