The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 354, 506 and 406 of the Indian Penal Code.

As per the FIR, the informant along with others went to the house of the petitioner to demand her money, as her husband had sent Rs.50,000/- for her in the account of the petitioner as she did not had any bank account. The informant’s husband sent money in the account of the petitioner because petitioner is a relative of the informant. The allegation against the petitioner is that he did not gave the amount to the informant and when the informant went to ask for it, the petitioner assaulted her.

It is submitted by learned counsel for the petitioner that

petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He submits that the petitioner had already returned the amount to the informant on 08.02.2023, which is also mentioned in para-4 of the supplementary affidavit. Petitioner has five criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Arrah Town P.S. Case No.791 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
