2 . The petitioner is apprehending his arrest in a case in connection with Siwaipatti P.S. Case No. 71 of 2023 dated 21.03.2023 registered for the offences punishable u/ss 341, 344, 376, 326, 504, 506 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the co-accused, Sanju Kumari took the informant to her house to perform dance in Orchestra. Later on, the informant was taken to meet with one Sikandar Sahni and left her away by the co-accused, Sanju Kumari. The petitioner and the co-accused person used to lock the informant in a room and take her to Orchestra. Further, they used to physically and sexually assaulted her on 20.03.2023.

Thereafter, the informant escaped from that place.

4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner has no concern with the alleged offence. It is further submitted that the victim in her examination-in-chief has not stated the name of the petitioner in the alleged crime. The supplementary affidavit filed on behalf of the petitioner which is kept on the record. The supplementary affidavit is being filed in view of the deposition of the informant before learned trial court and she has stated that she has worked in Orchestra and her dues of work is pending on its owner. She has stated that on the instance of Mukhia, she has lodged the present case. She has also stated that she was not miss behavioral by any accused persons. The co-accused persons have already been granted regular bail by this court vide order dated 25.06.2024 passed in Cr. Misc. No. 5233 of 2023. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his

arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned court concerned, Muzaffarpur in connection with Siwaipatti P.S. Case No. 71 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
