2 . The petitioner has preferred this application for grant of regular bail in connection with Naugachia P.S. Case No. 397 of 2023 dated 28.11.2023 registered for the offences punishable u/s 366A and 34 of the I.P.C. and Section 25(1-B) (a), 26, 37 of the Arms Act.

3 . As per the prosecution case, the co-accused Suraj Kumar @ Loochoo are alleged to have kidnapped the minor daughter of the informant with the assistance of the Petitioner and Sonakshi Kumari. The petitioner armed with weapon was caught with the help of villagers. Accordingly, the present F.I.R has been lodged.

4 . Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there was love affair between the victim girl and the co-accused Suraj Kumar @ Loochoo . As per the statement recorded under Section 164 of the Cr.P.C. the victim went to Delhi with the co-accused Sooraj Kumar and led their conjugal life with their own will. It is further submitted that the victim was not forced to have illicit intercourse with another person. There is no specific allegation against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.11.2023.

5 . Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the nature of allegation levelled against the petitioner and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with Naugachia P.S. Case No. 397 of 2023.
