2 . The petitioner is apprehending his arrest in a case in

connection with Sour Bazar P.S. Case No. 711 of 2023 dated 14.11.2023 registered for the offence/s punishable u/ss 406, 419, 420, 468 and 471 of the Indian Penal Code.

As per the prosecution case, the sale deed no. 16400 dated 25.11.1980 was executed by one Sri Shivnandan Singh in the name of four sons of Late Thakur Prasad Singh, namely Late Brahmdev Narayan Singh, Shri Vishundev Narayan Singh, Sri Kameshwar Singh and Shri Gyandev Singh. Currently, in the website of Bihar Government, this land has been shown in the name of Taranand Singh and the petitioner

Gopal Prasad Singh @ Ram Gopal Singh. Even Register-II also stands in the name of Taranand Singh and the petitioner Gopal Prasad Singh @ Ram Gopal Singh. It is further alleged that the petitioner and the co-accused persons along with some unknown persons tampered with the original copy of sale deed.

4 . Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is a case of civil dispute. It is further submitted that the petitioner has no direct or indirect involvement in tampering with the revenue records lying at Block office. It is further submitted that the petitioner has neither filed any petition for creation of the Jamabandi in his name nor he had filed any false document in support thereof. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5 . Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to

the satisfaction of the learned court concerned, Saharsa in connection with Sour Bazar P.S. Case No. 711 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
