Heard learned counsel for the petitioner and Mr. Dilip Kumar No.1, learned APP for the State.

Petitioner is seeking regular bail in connection with Baruraj (Muzaffarpur) P.S. Case No.32 of 2023, registered for the offence punishable u/s 120(B), 121, 121A, 153A, 153B of the IPC and sections 10 and 13 of Unlawful Activities (Prevention) Act.

The petitioner is alleged to be a member of PFI who were hatching criminal conspiracy to disrupt communal harmony and also to disrupt the sovereignty and territorial integrity of India and to execute such acts new members were being recruited and training was imparted with intent to strengthen further activity of PFI.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior motive. No incriminating article has been recovered from the conscious physical possession of the petitioner. One Riyaz Mourif @ Bablu is an accused in the same case and is the maternal step brother of the petitioner and as he used to visit the house of the petitioner sometimes, the name of petitioner got surfaced in this case. Petitioner has no criminal antecedent and is languishing in custody since 21.09.2023.

Learned APP for the State opposed the prayer for bail by submitting that petitioner is a member of the PFI and during the search of his premises, one printed banner of PFI and two swords have been recovered.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of regular bail on his behalf is hereby rejected.

This application is accordingly dismissed.
