The petitioner apprehends his arrest in connection with Danapur P.S. Case No. 1069 of 2023 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379 and 385 of the Indian Penal Code.

As per prosecution case, all the FIR named accused persons including this petitioner assaulted the informant, as a result of which, he sustained multiple grievous injuries.

Submission of learned counsel for the petitioner is that the allegation of assault is general and omnibus. No specific overact is alleged against the petitioner. For the same occurrence there is case and counter case between the parties.

Learned A.P.P. appearing on behalf of the State and learned counsel for the informant opposed the prayer for bail by contending that there is direct allegation of assault against this petitioner due to which informant sustained multiple grievous injuries. Petitioner has got 9 criminal antecedents. Hence, he does not deserve to be enlarged on anticipatory bail.

Having considered the nature of the accusation and the long criminal history of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected.
