The instant appeal has been filed by the appellant against the order dated 2.12.2023 passed by learned Exclusive Special Court, SC/ST Act, Patna whereby the prayer for bail of the appellant in connection with Bihta P.S. Case no. 852 of 2022 under Sections 341, 323, 307, 302, 147, 148, 149 of the Indian Penal Code, section 27 of the Arms Act and sections 3(2)(a) of SC/ST Act was rejected.

Earlier the appeal for regular bail of the appellant was rejected by this Court vide order dated 24.8.2023 passed in Cr. Appeal (SJ) No. 823 of 2023 with a direction to trial court to

expedite the trial and conclude the same at the earliest.

It is submitted by learned counsel for the appellant is that the trial has not been concluded as yet knowing the fact that the appellant is languishing in custody since 31.8.2022.

In pursuance to the direction of this Court, a report dt. 7.2.2024 with regard to present stage of trial has been received by which it appears that the trial is likely to be concluded within six months.
