The present writ petition has been filed for quashing the notification with regard to the petitioners’ land vide S.O. 5364 (E) dated16.10.2018 issued by the Chief Administrative Officer/ CON II of Railway Board, New Delhi whereby and whereunder the petitioners’ land have been acquired on which the house of the petitioners situated since long.

Counsel for the petitioners submits that in the periphery of the petitioners’ land, there are large chunk of vacant land and if the railway line shall be shifted, then the entire house of the petitioners shall be safe.

Counsel for the Union of India raised preliminary objection that the Union of India has every sympathy for the petitioners that the house of the petitioners are subject to acquisition for the purpose of construction of railways line for Dalkhola New BG Line Project under the District-Katihar, but the construction of railway line is a technical issue and decision used to be taken after taking technical advice from the experts at different levels. Counsel submits that it is the standing instructions of the railway board that minimum disturbance to the people at large should be made.

been deposited and petitioners are at liberty to accept the award amount with objection and may raise higher value, if they are not satisfied with the said amount.

Upon hearing the parties, this court is of the view that under constitution, the Right to Property is no more Fundamental Right rather it becomes the constitutional right. As such, the important infrastructure projects like construction of railways line cannot be shifted without technical approval which used to come after crossing series of experts opinion. Hence, this court is not inclined to grant relief to the petitioners. Though liberty has been granted to the petitioners that upon receiving their compensation amount with objection, they shall be at liberty to raise claims for more compensation amount permissible in law as contained in the Railways Act, 1989.

With this direction, the present writ application is hereby disposed of.
