Heard Mr. Nishant Kumar Sinha, learned counsel appearing on behalf of the petitioners; Mr. Nikesh Kumar, learned counsel for Zila Parishad and Mr. Kameshwar Prasad Gupta (GP 10) along with Ms. Deepanjali Gupta (AC to GP 10), learned counsels for the respondents.

Petitioners have filed the present writ petition for

the relief(s), as prayed for in paragraph no.1 of the writ petition, which is inter alia reproduced as under :

(i) For directing the respondent authorities to allot the shop to the petitioners on preferential basis in the market complex which is being built on the land of Zila Parishad, Saran at Chapra situated beside Dighwara Railway Station, Fider Path in view of the fact that the authority had already taken requisite money/draft from the petitioner since 2015.

(ii) For directing the respondent authorities commanding them to allot the shops to petitioners at the same/near place from where they were vacated in the name of construction of market complex in view of the

value/importance of the location.

(iii) For directing the respondent authorities to allow the petitioners to install temporary shops until the final order of allotment is passed by this Hon’ble Court keeping in view that the petitioner families are on the verge of starvation.

(iv) Any other relief or relief which may be granted to the petitioners if they are found legally entitled in the fact and circumstances of the case.”

It is informed that out of 61 petitioners, 41 petitioners have been allotted shops, as per direction of the Hon’ble High Court passed in several writ petitions. Following 12 writ petitioners have not been allotted any shop and the order has been passed to refund their money by the Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parishad, Saran on the ground that they were not encroachers, as identified by the Zila Parisad : -

Considering the aforesaid status of 12 petitioners, who have claimed their right by furnishing requisite amount for allotment of shops but in absence of any pleadings made in the writ petition, this Court finds it proper that they may make detail applications before the Deputy Development Commissionercum-Chief Executive Officer, Zila Parishad, Saran, to make out their individual case as to whether they are covered by any of the judgment and order passed by this Court.

The Deputy Development Commissioner-cumChief Executive Officer, Zila Parishad, Saran is directed to call for the records with respect to above 12 petitioners, whose applications have been rejected and thereafter giving them proper opportunity of hearing may proceed to pass order in accordance with law within a period of two months from the date of communication of this order.

With the above observation/direction, the present writ petition is disposed of.
