Heard Mr. Shubh Narain Singh, learned counsel appearing on behalf of the petitioner, Mr. Madhaw Pd. Yadaw, learned GP-23 appearing on behalf of the State, Mr. Ritesh Kumar, learned counsel appearing on behalf of the J.P. University and Mr. Zaki Haider, learned counsel for the B.R.A. University.

the post of Assistant Stenographer has filed the present writ petition seeking following relief(s):

“I. For commanding and directing the respondents for payment of retirement benefits and other consequential benefits attached to the post like:

(i) Group Insurance with 12^1/2 %

¶25

compound interest.

(ii) For payment of ACP/MACP difference of salary with 30%.

¶27

(iii) Difference of salary from March 1981 to October, 1992 of B.R.A.B. University, Muzaffarpur.”

Learned counsel appearing on behalf of the

petitioner submitted that petitioner was initially appointed as an Assistant Stenographer in H.R. College, Mairwa on 26.03.1979, which was a constituent unit of Bihar University but after bifurcation in the year 1992, the said college came within the jurisdiction of J.P. University.

Mr. Ritesh Kumar, learned counsel appearing on behalf of the J.P. University admits that the dues as claimed by the petitioner in above paragraphs still remains to be paid. Learned counsel further informs that the University is stressed due to non-availability of fund.

If it is true, the Vice Chancellor and the Registrar of the University are required to personally approach the Additional Chief Secretary, Higher Education Department,

Government of Bihar, who will at least ensure disbursal of fund at the level of Additional Chief Secretary, Finance Department which is required by the University for the payment to be made to the petitioner.

The Registrar of the B.R.A. Bihar University, Muzaffarpur as well as J.P. University Chapra, must forthwith redress the grievance of the petitioner and make payment within a period of three weeks.

In case, the order is not complied with, the petitioner may file a contempt petition before this Court for willful non-compliance of the order.

With the above observation/direction, the present writ petition is disposed of.
