Heard learned counsel for the petitioner and learned
A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with three antecedent and the informant alleges that one Ranjit Kumar is owner of New National Body Builder Garage and he alongwith accused persons are indulging in committing theft of trucks and thereafter they modify the body of the truck and sell. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from perusal of the allegation as alleged in the FIR it would manifest that only

allegation against him is that he alongwith two unknown persons had brought the truck to the garage of Ranjit. It is next submitted that since petitioner was implicated earlier in three cases as such, in the present case also he came to be implicated falsely. It is next submitted petitioner will not abscond rather will cooperate in the investigation and will present himself as and when required by the Investigating Officer.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Harnaut P.S. Case No. 367 of 2018 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
One of the bailor of the petitioner shall be his father Vilash Yadav @ Vilash Gope.
However, in the event if any application filed on

behalf of the Investigating Officer bringing to the notice of the learned trial court that petitioner despite giving assurance to this Court is not cooperating in the investigation or is not presenting himself when required then the learned trial court would be at liberty to cancel his bail bonds after recording reasons.
Let a copy of this order be sent to the concerned P.S. through the learned trial court.
