The petitioner apprehends his arrest in a complaint case punishable for the offences under Sections 420, 467, 468, 406/34 of the Indian Penal Code.

It is alleged that on the assurance of petitioner that he would send the brother of complainant to abroad for job, the complainant gave Rs. 1,00,000/- to the petitioner and decided to give remaining Rs. 50,000/- at the time of visa. It is further alleged that after few days, petitioner came with visa and complainant gave Rs. 50,000/- to the petitioner and petitioner assured that within ten days he would get flight, but after lapse of several months the complainant did not get flight for his brother, he asked the petitioner to return his money, the petitioner refused to return the said money.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. The complaint neither disclose the date and time when the alleged money was given to the petitioner nor any mode of payment and only a vague & general allegation has been levelled against petitioner. Petitioner claims clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Gopalganj in connection with Complaint Case No. 1826 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
