3 18-07-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a complaint case punishable for the offence under Sections 406, 471, 34 of the Indian Penal Code.

In this case, a supplementary affidavit has been filed on behalf of petitioner wherein it is stated that petitioner is under-treatment at P.G.I. Chandigarh, but he is ready to refund the admitted amount of Rs. 8,00,000 (Rupees eight lacs) in installments to the complainant/opposite party no. 2 within six months.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks

from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Barh, District - Patna in connection with Complaint Case No. 96 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, with further following conditions:

A . At the time of furnishing bail-bond Rs. 1,00,000/(Rupees one lac ) shall be refunded through Bank Draft to the complainant/opposite party no. 2.

B . Rest amount i.e. Rs. 7,00,000/- (Rupees seven lacs) in seven installments i.e. Rs. 1,00,000/- (Rupees one lac) per installment within a period of one year from the date of furnishing bail-bond.

C . If petitioner fails to comply with the aforesaid direction of this Court, the Court below is free to cancel the bail-bond of the petitioner.
