4 11-12-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in connection with Daudnagar P.S Case No. 426 of 2022 dated 01.08.2022 registered for the offence punishable u/s 420, 467, 468 of the Indian Penal Code.

As per the prosecution case, the informant Indu Devi purchased the pertaining land area of 0.402 decimal, plot no.- 1, Khata no.- 149 in Daudnagar through registered sale deed situated at Daudnagar and she is in peaceful possession of the aforesaid land from the date of purchase. It has been further

alleged that accused petitioner Sanjay Prasad Kasyankar @ Sanjay Kumar made a forged document with an intent to grab the aforesaid land of the informant. The aforesaid fact came into the knowledge of the informant when she received a vakalatan notice that was sent by the accused petitioner Sanjay Prasad Kasyankar @ Sanjay Kumar through his lawyer. The informant or her husband has never executed any documents regarding the aforesaid land in favor of the petitioner, Sanjay Prasad Kasyankar @ Sanjay Kumar.

5. Learned counsel for the petitioners have submitted that the petitioners have been falsely implicated in this case. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. The petitioner no. 2 and 3 are the witnesses of the said document.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioners namely Sanjay Prasad Kasyankar @ Sanjay Kumar, Nathuni Yadav, Madheshwar Yadav Ramdeo Singh, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs.

20,000/- (Rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, S.D.J.M. Daudnagar in connection with Daudnagar P.S Case No. 426 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
