Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 197 of 2023, registered for offence punishable under section 304/34 of the Indian Penal Code.

As per FIR, on 19.05.2023 at about 10:00 A.M. the informant along with his father went to irrigate his agricultural land. The informant’s father was irrigating the land and the informant was plucking jackfruit. In the meantime, the merchant came and asked the informant about his father, on which he stated that his father is irrigating the field on the other side of the road. As soon as the merchant went and saw the informant’s father had been electrocuted, as naked wire in which accused Pramod Singh had passed electricity, was touching the body of the informant’s father. connection and the informant’s father was taken to a private doctor, who declared him dead.

The learned counsel for the petitioner has submitted that the petitioner is innocent and he is a person of clean antecedent. There is no allegation against the petitioner of erecting electric wire in the field, rather it is against his father. The petitioner has falsely been implicated in this case merely because he is son of the main accused Pramod Singh.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 197 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
