Heard learned counsel for the petitioner and learned
APP for the State.
The petitioner is apprehending her arrest in connection with Kudhni P.S. Case No. 137/2021, registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 pending in the learned court below.
After some arguments, learned counsel for the
petitioner seeks permission to withdraw this application.
Permission is granted.
Accordingly, the instant application is dismissed as
withdrawn.
However, if the petitioner surrenders before the
Patna High Court CR. MISC. No.5172 of 2023(2) dt.07-04-2023 2/2
learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that the petitioner is a lady.
