Heard learned Counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 342, 324, 325, 307, 353, 332, 333, 427, 337, 338, 15, 152, 186, 504 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution, a case has been lodged against 38 named accused persons and 70 unknown persons, that they assaulted Chowkidars and police personnel with lathi, danda, bricks, stones due to which one Chowkidar sustained injury on his head.

It is submitted by learned counsel for the petitioners

that petitioners are innocent and have committed no offence. Counsel for the petitioners submits the allegation made in the FIR is general and omnibus in nature. He further submits that case and counter case has been filed in which it has been alleged that the Chowkidar s and other police personnel were misbehaving with the dancers due to which the villagers opposed them and it resulted into the scuffling.

Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of Rs. 30,000/(Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Motihari, East Champaran, in connection with Harsidhi P. S. Case No.421 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
