Heard learned counsel for the petitioner as well as learned APP for the State.

Learned counsel for the petitioner has submitted that the anticipatory bail petition of the petitioner was rejected by this Court vide order dated 01.02.2023 in Cr. Misc. No. 54101 of 2022. He has submitted that the fresh ground for filing the application is that the Investigating Authorities have submitted the final form as no material emerged against the petitioner during investigation and on similar footing, three coaccused persons have been granted anticipatory bail vide order dated 29.04.2023 in Cr. Misc. No. 58543 of 2022. It has also been submitted that the petitioner is a patient of cancer and in this respect, some medical papers have been filed.

Considering the above-mentioned facts and circumstances, especially the fact that other co-accused, on similar footing, have been granted bail and no material emerged against the petitioner, let him, be released, in the event of his arrest or surrender within four weeks before the learned court below,, on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jhajha P.S. Case No. 193 of 2021, subject to the following condition:-

The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
