Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends arrest in connection with Hawaiadda P.S. Case No. 83 of 2021 dated 01.04.2021, instituted for the offence punishable under Sections 419, 420, 467, 468 and 120(B) of the Indian Penal Code and 10 Bihar Conduct of Examination Act, 1981.

3. The prosecution case is related to committing forgery in an exam resulting into mismatch of thumb impression of the petitioner at the time of counseling.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is submitted that the F.I.R. has been lodged on the basis

of mismatching the thumb impression of 71 candidates in the process of selection and appointment of Driver conducted by Bihar Staff Selection Commission. It is further submitted that the Bio-matic thumb impression is not matched, without verifying the Video recording, C.C.T.V. footage and signature of the petitioner, which shows the bias and illegal act of the informant. It is further submitted that similarly situated persons have been granted bail by different Benches of this Court on different dates (Krishna Kumar vide order dated 14.12.2021 passed in Cr. Misc. No. 46868 of 2021, Amitabh Anand vide order dated 22.06.2022 passed in Cr. Misc. No. 52796 of 2021, Santosh Kumar vide order dated 04.07.2022 passed in Cr. Misc. No. 55232 of 2021, Indrajeet Kumar vide order dated 18.10.2022 passed in Cr. Misc. No. 29200 of 2022 and Santosh Kumar vide order dated 17.01.2023 passed in Cr. Misc. No. 50598 of 2022) . Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of

six weeks from today, in connection with Hawaiadda P.S. Case No. 83 of 2021, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge XI – Cum – A.C.J.M., Patna, subject to condition as laid down under Section 438(2) of the Cr.P.C.
