Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present and he has no criminal antecedent. Earlier, the anticipatory bail of the petitioner was rejected by a Co-ordinate Bench of this Court vide order dated 23.12.2020 in Cr. Misc. No. 81 of 2017 due to wrong submission on behalf of learned counsel for the petitioner. It is further submitted that during the tenure of the petitioner, the company had received only Rs. 10 lakhs against advance payment as per the first agreement and rest payments have been made after his tenure i.e. leaving the organization,

which has been mentioned in Annexure 7. It is further submitted that during the enquiry, no adverse allegation against the petitioner was found.

Learned counsel for the petitioner further submits that he wants to withdraw this application with a liberty to surrender before the learned Court below within six weeks from today and seeks regular bail and the learned Court below is directed to pass order on the same day in accordance with law without being prejudiced by this order considering the fact that in the tenure of the petitioner, the company had received only Rs.10 lacs against advance payment as per the first agreement.

Accordingly, this application is dismissed as withdrawn with the liberty aforesaid.
