Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail registered for the offence punishable under section 395 of the IPC and Section ¾ of the Explosive Substance Act.

This case relates to theft of cash of Rs. 6,00,000/0 along with ornaments and household electronic items from the house of the informant.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. No TIP has been done. Name of the petitioner came into light on the basis of confessional statement of Babujan Nadaf, before the police, which has no evidentiary

value in the eye of law. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 08.02.2023 passed in Cr. Misc. No. 43357 of 2022. Petitioner is languishing in judicial custody since 31.5.2022.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar (Sitamarhi) in connection with Bela P.S. Case No. 127 of 2020.
