grant of regular bail in connection with Rajepur P.S. Case no.169 of 2022 registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted, about 1193 litres of IMFL was recovered from the straw house of the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The petitioner has not been arrested at the spot. The name of the petitioner transpired in the confessional statement of a co-accused. The petitioner is in custody since 6.2.2023. Chargesheet has been

taking into consideration the nature of allegation in the F.I.R., the petitioner having remained in custody since 6.2.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Rajepur P.S. Case no.169 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1, Civil Court, East Champaran, Motihari.
