The petitioner is in judicial custody in connection with S.T. No. 735 of 2019 arising out of Alamganj P.S. Case No. 389 of 2021 for the offence registered under Sections 302, 120B read with section 34 of the Indian Penal Code.

Earlier report was called for which has since been received and vide letter No. 75 dated 17.05.2023, it till the said date, no witness has been examined.

It has been contended by the learned counsel for the petitioner that co-accused Ranjeet Gope @ Ranjeet Kumar @ Ranjeet Roy has been granted bail by a co-ordinate bench on 11.01.2022 in Cr. Misc. No. 68161 of 2022 (Annexure 5 to the petition).

Taking into account the fact that the omnibus

allegation has been made against all the accused persons including the petitioner herein, similarly situated co-accused, Ranjeet Gope @ Ranjeet Kumar @ Ranjeet Roy has since been released on bail bail and he is in custody since 09.07.2021 (as stated in paragraph-17 of the petition), this Court is inclined to grant him privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District Judge -I, Patna City, Patna/concerned Court in connection with Sessions Trial No. 735 of 2019 arising out of Alamganj P.S. Case No. 389 of 2021, subject to the following conditions:

(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his/her bona fide ;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every month till the conclusion of the trial to mark

his attendance;

¶25

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of his bail bonds;

(v) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of the bail bonds.
